The legal representatives of the petitioner, i.e. the applicants, moved applications for condonation of delay caused in bringing their names on record by condoning the delay caused in setting aside an abatement order, if any, passed in the petition, who died on 30.10.2023. Also, they prayed that their names be brought on record in the place of the deceased petitioner. Therefore, applicants urged that said delay be condoned, and their names be incorporated in the title clause in the place of the original petitioner by setting aside an abatement order, if any passed. The learned Assistant Government Pleader has no objection to the same.

As such, both applications are allowed as prayed. The delay caused in bringing the names of the applicants on record is hereby condoned by setting aside an abatement order.

The applicants are directed to carry out the amendment within two weeks, place a copy of the amended petition on record, and supply the copy of the amended petition to the respondents by the returnable date.

List the petition on 15.01.2025.
