That the notice issued to the aforesaid respondent is received back unserved for want of correct address.

Thus, the applicant is furnishing correct address of respondent no. 11. Secondly, since the respondent no.5 is reported to be dead and her legal heirs are already on record as respondent nos. 6 to 10, the applicant prays for deletion of name of respondent no.5 from the array of the respondents. The application is supported by affidavit.

Since the application is formal in nature and supported by affidavit, the same is allowed. Applicant is permitted to delete the name of respondent no.5 from the array of the respondents, at the risk of the applicant. Necessary amendments be carried out in the cause title of the matter. Thereafter office to issue notice to the aforesaid respondent no. 11, returnable within six weeks.
