CIVIL APPLICATION (CAW) NO. 1712 OF 2024 .

On 30/10/2023 following order was passed :

"

Since the respondent, in whose favour the learned School Tribunal has ruled, has already superannuated, the petitioners shall submit his pension papers to the appropriate authorities.

List the matter after Diwali vacation."

The learned Counsel for Respondent No.1/Applicant submits that the Petitioners have submitted pension papers, however, have not submitted fixation of pay and unless the fixation of pay is filed, Respondent No.1 will not get legitimate pension.

The learned Counsel for Petitioner seeks time to take instructions. It is unfortunate that the correct papers were not submitted.

In view of above and for the reasons set out in the Application, Civil Application is allowed.

The Petitioner shall submit the documents of fixation of pay within three weeks from today to the Respondent No.2 - Project Officer, who shall process the file in accordance with Rules within two weeks thereafter.
