It is stated in the application that the notice issued to respondent no.5 returned back unserved with bailiff report that the said respondent is reported to be dead and the petitioner does not intend to prosecute the legal heirs of the said respondent no.5. Thus, the applicant prays for deletion of the respondent from the array of the respondents. The application is supported by affidavit.

Considering the reason mentioned in the application and the bailiff report, the applicant is permitted to delete respondent no.5 from the array of the respondents, at the risk of the petitioner. Necessary amendments be carried out in the cause title of the matter. (D.P.
