CAW No. 2172/2024 in Writ Petition No. 133/2024 Coram : Registrar (Judicial) Dated : 23.08.2024 This application is taken out for permission to supply correct address of respondent no.4, 5 and 6 and deletion of respondent no.3. It is stated in the application that the petitioner was not aware about the death of respondent no.3 and after enquiry it was revealed that the said respondent passed away on 22.01.2009 and her legal heirs are already on record.

Therefore, the counsel for the petitioner seeks to delete the name of aforesaid respondent no.3 from the array of the respondents.

Secondly, the notices issued to the aforesaid respondent nos. 4, 5 and 6 are received back unserved for want of correct address. Thus, the applicant/petitioner is furnishing correct address and name of the aforesaid respondents as mentioned in the application. The application is supported by affidavit.

Since the application is formal in nature and supported by affidavit, the same is allowed. Necessary amendments be carried out in the cause title of the matter.

Thereafter office to issue notice to the aforesaid respondents, returnable within six weeks and the petitioner is permitted to delete the name of respondent no.3 at the risk of petitioners from the array of the respondents.
