It is stated in the application that name of respondent no. 2 as Roshan Manohar Gharde is properly recorded, however, the name of Prakash Monohar Raut mentioned in the array of respondent no.2 as legal heir of Suraj Prakash Raut came to be mentioned inadvertently. Thus, the applicant wants to delete the name of Prakash Manohar Raut from the array of the respondent no.2 only.

The applicant further prays for deletion of respondent nos. 3 and 12 as they are reported to be dead as per bailiff report.

The applicant is furnishing correct addresses of respondent nos. 4, 5, 7, 9, 13 as mentioned in the application.

Since the application is formal in nature and supported by affidavit, the same is allowed. Necessary amendments be carried out as regards deletion of respondent nos. 2 - Prakash Manohar Raut, respondent nos. 3 and 12 and as regards supplying correct addresses of the respondents as mentioned in the application. Thereafter office to issue notice to the aforesaid unserved respondents, returnable within six weeks.
