WRIT PETITION NO.7996 OF 2023 3.

The petitioner is a former Director of respondent No.7-Bank, and his grievance is that respondent Nos.1 to 6 have failed to initiate any action against respondent No.7-Bank despite the adverse findings recorded in the Audit Reports for the financial years 2013-14, 2014-15, 2015-16, and 2019-20.

It is pointed out that, in the earlier round of litigation

2/3 in Writ Petition No. 2764 of 2021 (Dr. Dattatraya s/o Jaikrishna Gotmare v. State of Maharashtra and others), decided on 06.08.2021, a grievance was raised regarding the pendency of the revision application filed against the Audit Reports and the failure of the authorities to take any decision thereon. Consequently, this Court, by issuing Rule, directed the respondent No.1 (Secretary, Cooperation Department, Mantralaya, Mumbai) therein, to dispose of the said revision application within a period of eight weeks. However, despite the aforesaid direction, the revision application is still pending till date.

Thus, it is the grievance of the petitioner that the respondent Nos.1 to 6 are not taking the matter to its logical end as per Section 88 of the Act of Maharashtra Cooperative Societies Act, 1960 (for short ' the Act of 1960') 6.

Considering the prayers sought and the grievance raised in the present petition, we are of the opinion that the ends of justice would be served, if the respondent No.2 - Commissioner for Cooperation, Maharashtra State, Pune, is directed to treat the present petition as a representation made by the petitioner, and take a decision on the same within a stipulated period.

Accordingly, we dispose of the present petition with direction to the respondent No.2 to treat the present petition as a representation made by the petitioner and after

3/3 considering the grounds raised in the present petition and the documents filed along with the present petition, take decision.

Such exercise shall be completed within three months from the date of production of this order and the copy of the present petition.

The learned counsel for the petitioners undertakes to furnish copy of this order as well as the copy of the present petition and the necessary documents, to the concerned respondent within two weeks from today. 10.

The decision taken shall be communicated to the petitioner within two weeks from the date of such decision.

Accordingly, the writ petition is disposed of in the above terms. No order as to costs.
