DATE : 25TH SEPTEMBER, 2025 The petitioner filed Civil Application (W) No.3209 of 2024 for grant of permission to amend the petition. By way of this amendment, the petitioner is challenging the order of termination dated 27/11/2021. In view of specific provision under section 9 of the Maharashtra Employees of Private Schools (Conditions of Services) Regulation Act, 1977, the remedy lies before the School Tribunal. As such, the amendment application is rejected.

So also, in view of this provision, the petitioner, on instructions, seeks permission to withdraw the petition with liberty to file appropriate proceedings before the School Tribunal. As such, the petition stands dismissed as withdrawn with liberty as prayed for. All contentions of the parties are kept open.

The School Tribunal may consider for condonation of delay and the fact that petition was pending there since 2023.
