This is an application for condonation of delay 3.
There is delay of 327 days in filing first appeal. The reason mentioned in the application is that the entire record was sent to the Legal Department at Mumbai. Therefore, it consumed time in preferring first appeal. 4.
Though, the respondents are served, nobody appears for them. Therefore, the contentions made in the application remained uncontroverted.

Considering the period of delay and the reason mentioned in the application, the delay caused in filing first appeal is condoned, subject payment of costs of Rs.3,000/- (Rupees three thousand only) to the Tiroda Bar Association, Dist. Gondia, within two weeks.

The application is allowed and disposed of.

The appeal be registered.
