02/2021 dated 28.09.2021. It is stated that except respondent nos. 1 to 4, there are no other legal heirs of the deceased respondent no.5 - Smt. Hiran Tularam Parteki. Thus, the appellant prays for deletion of respondent no.5 as her legal heirs are already on record.

Since the application is formal in nature and supported by affiddavit, the same is allowed. The appellant is permitted to delete the name of respondent no.5 from the array of respondents, at the risk of the appellant.
