Shashikala Hiraman Paikrao v. The State Of Maharashtra Through The Collector, Yavatmal And Others

CAF No. 399/2024 in First Appeal No. 1810/2019 Coram : Registrar(Judicial) Dated : 20.02.2024 This application is filed by the applicant for bringing legal representatives of deceased appellant- Shashikala Hiraman Paikrao on record, who is reported to be passed away on 09.12.2023 as per the death certificate enclosed with the application.

It is seen that appellant passed away on 09.12.2023 and the present application for bringing LR's of deceased appellant is filed on 05.02.2024 i.e. within time and right to sue survives. Alongwith the application, the applicant has enclosed legal heris certificate issued by the concerned authorities mentioning that the proposed legal heirs of the appellant i.e. 1(a) to 1(e) are the only legal heirs of the deceased appellant. The application is supported by affidavit.

Hence, the application is allowed. Legal heirs of deceased appellant be brought on record.

Necessary amendments be carried out in the cause title of the appeal memo.
