NO. 406/2025 IN FIRST APPEAL NO. 45/2023 CORAM : REGISTRAR (JUDICIAL) DATED : 25/02/2025 The civil application is filed under Order V Rule 20 of the C.P.C., 1908 for substituted service upon R.No. 3 by way of paper publication. It is stated in the application that appellant has given the last known address of R.No. 3 on record. It is further stated that R.No. 3 is deliberately avoiding service of notice. So, appellant prays for substituted service.

Hence, considering the reasons mentioned in the application, the appellant is allowed to serve aforesaid respondent by substituted service on the last known address by paper publication.

Substituted service be effected upon aforesaid respondent by publishing a notice in widely circulated local daily newspaper 'Amar Ujala' Mumbai in terms of Order V Rule 20 (1-A) of C.P.C., returnable within five weeks from the date of publication of notice.
