These rival applications are from acquiring body and claimants seeking interim reliefs. Acquiring body is seeking to stay the execution of impugned award for the various reasons which we have noted in our order dated 22.12.2023. On the other hand, the claimants are seeking withdrawal of the amount by contending that considering the entire material, reference Court has passed appropriate award of compensation. It is submitted that this Court has already granted interim stay on deposit of 50% of the award and thus he may be permitted to withdraw at least that much amount. 2.

We have considered rival submissions and Kavita

27-caf 626-24.odt 2/2 gone through the impugned award. Considering all the circumstances, interim order of stay is hereby made absolute till the disposal of the appeal.

The claimants are entitled for withdrawal of 25% of the deposited amount on usual undertaking and remaining 25% of the deposited amount on furnishing solvent surety to that extent.

Both the applications are disposed of in above terms.
