Heard learned advocates for the parties.

This is an application for speaking to minutes in respect of the judgment and order dated 21.09.2023 in First Appeal No. 814/2012.

It is stated that the appellant-Railway has already deposited Rs.2,65,973/- before the Railway Claims Tribunal, Nagpur Bench, Nagpur. It is submitted that therefore, the appellant is liable to pay the balance amount i.e. Rs.5,34,027/-.

Accordingly, in place of earlier paragraph 22 of the judgment and order, the modified paragraph 22 is as under : "The appellant has already deposited Rs.2,65,973/- with the Railway Claims Tribunal, Nagpur. The appellant is directed to deposit the balance amount of Rs.5,34,027/- within four months from today in the bank account of

2 7 caf911.24.odt respondent/claimant, directly. The respondent shall provide the particulars of his bank account to the appellant." 5.

Necessary correction be carried out in the judgment and order dated 21.09.2023 and corrected judgment be uploaded.
