CAF NO. 979/2024 in First Appeal No. 996/2018 Coram : Registrar(Judicial) Dated : 26.03.2024 This application is taken out for grant of permission to delete name of appellant no.1 (ii). It is stated that during the pendency of appeal, the appellant no.1 (ii) Kaushalyabai Tukaram Chavhan is expired on 13.08.2022 and her legal heris are already on record i.e. appellant nos. 1(i) 1(iii), 1(iv) and 1(v). Copy of death certificate of said appellant no.1(ii) is on record. Thus, the appellants pray for deletion of appellant no.1 (ii) as her legal heirs are already on record.

Since the application is formal in nature and supported affiddavit, the same is allowed. The appellants are permitted to delete the name of appellant no.1 (ii) from the array of appellants, at the risk of the appellants.
