CAF NO. 982/2024 in First Appeal No. 113/2012 Coram : Registrar(Judicial) Dated : 26.03.2024 This application is taken out for grant of permission to delete name of respondent no.5. It is stated that the Hon'ble Court vide order dated 12.08.2021 in CAF No. 1043/2021 has granted permission to delete the name of respondent no.5 upon orally requested by counsel for respondent nos. 1 to 5, as she is reported to be dead. The said CAF No. 1043/2021 was filed by respondents/claimants for withdrawal of amount. Thus on the basis of the said order, the appellant prays for deletion of respondent no. 5 from the array of the respondents.

Since the application is formal in nature and supported affiddavit, the same is allowed. The appellant is permitted to delete the name of respondent no.5 from the array of respondents, at the risk of the appellant.
