This is an application for withdrawal of remaining amount deposited by the appellant as per the Award of the Reference Court.

Learned advocate for the respondent No.1/claimant submits that already, 50% amount is withdrawn by the respondent No.1/claimant.

Considering the peculiar set of facts, it would be proper to allow this application partly.

The respondent No.1 is entitlled to withdraw 25% amount out of Rs.57,15,680/-.

Application is, thus partly allowed and disposed of.

6.

List the appeal after four weeks.
