By the present application, the applicant/appellant is seeking to condone the delay of 67 days caused in filing the appeal against the judgment and award dated 10.10.2023. 3.
The contention is that there is order by the Tribunal to the non-applicant No.1 to pay the deficit court-fees and the office was directed to draw the award after depositing the deficit court-fees. Accordingly, award was prepared after depositing the court-fees by the non-applicant No.1. Further contention is that the applicant was under impression that certified copy of the award/decree is required to file alongwith appeal. There is no counter reply.
4.
The reasons mentioned in the application is sufficient to condone the delay. Hence, the application is allowed and the delay of 67 days caused in filing the appeal is hereby condoned. Appeal be registered and numbered accordingly. TAMBE
