Anusayabai Chandrabhanji Dudhe v. Tulsabai Ganeshrao Chirde

CAF No. 1040/2024 in First Appeal No. 268/2008 with S.A. No. 247/2014 Coram : Registrar(Judicial) Dated :16.04.2024 This application is filed by the applicants for bringing them on record as legal heirs of deceased appellant - Anusayabai Chandrabhanji Dudhe. It is stated in the application that appellant expired on 15.01.2024 leaving behind her legal heirs. Hence it is necessary to bring LRs of deceased appellant on record as right to sue survives. The copy of death certificate is filed with the application. The application is supported by affidavit.

It is seen that the appellant passed away on 15.01.2024 and the present application for bringing LR's of the deceased is filed on 01.04.2024 i.e. within time and right to sue survives. Hence, the application is allowed. LR's of aforesaid deceased be brought on record. The applicants are permitted to delete the name of deceased appellant. Necessary amendments be carried out in the cause title of the appeal memo.
