This is an application filed by respondent no.1 for withdrawal of the amount of compensation deposited by the appellant in this Court.

It is stated that appellant has deposited the amount of Rs.39,70,789/- in this Court. It is further stated that the respondent no.1 has already withdrawn Rs.16,25,117/- deposited by the appellant in the Reference Court. 3.

In view of the reasons stated in the application, respondent no.1 - Babarao Panjabrao Choudhari (Deshmukh), is permitted to withdraw 50% of the amount deposited by the appellant in this Court, on furnishing usual undertaking.

The application is allowed and disposed of.
