That the notice issued to the aforesaid respondent is received back unserved for want of correct surname. As per the bailiff report dated 19.02.2024, the correct surname of respondent no.7 is 'Yerme' instead of 'Terne'. Thus, the applicant is furnishing correct surname of aforesaid respondent.

The application is supported by affidavit.

Since the application is formal in nature and supported by affidavit, the same is allowed. Necessary amendments be carried out in the cause title of the appeal. Thereafter office to issue notice to the aforesaid respondent, returnable within six weeks.
