This is an application for condonation of delay of 45 days caused for filing appeal.

Heard learned Advocates for both sides.

Learned Advocate for the appellant pointed out that for processing the proposal of preferring this appeal, delay of 45 days is caused. It appers that delay is not deliberately caused. Application deserves to be allowed, in the interest of justice.

Application is allowed. Delay of 45 days is condoned.

This is an application for permission to withdraw the amount deposited by the appellant as per the award.

Out of amount of Rs.7,08,841/-, Registry is directed to pay 75% amount to the respondent Nos.1 and 2 as follows :- i] 50% amount be paid on usual undertaking and 25% amount be paid on execution of solvent surety / security to the respondent Nos.1 and 2.
