This is an application filed by the original claimants seeking condonation of delay of 485 days in filing the statutory appeal.

In response to the notice, Advocate Mr. P.R. Agrawal, appears on behalf of respondent No.1. Learned AGP appears on behalf of respondent Nos.2 and 3-State.

It is submitted that the delay of 485 days occurred since the applicants were not aware about the requirement of filing the appeal in time and therefore, the delay is unintentional. Learned Advocate for the applicants states that the applicants are ready to waive the statutory benefits and interest for the period of delay.

Considering the reasons mentioned in the application and submissions advanced, the application is allowed and the delay of 485 days in filing statutory appeal is condoned, however, subject to the applicants-original claimants waiving the statutory benefits and interest for the period of delay.

The civil application is accordingly disposed of. 7.
