The contention is that the deceased, who was a labourer engaged by the owner of the vehicle for unloading Oranges from the vehicle, fell down in well and sustained grievous injuries resulting to his death out of employment of respondent no. 4. It is contended that the Tribunal has erroneously held that such incident is an accident took place due to use of Tata ACE vehicle bearing registration no. MH-04-DK-6376.
