It is brought to our notice that in similar matters arising out the same Award and under the same circumstances, this Court has considered the aspect of delay and granted limited stay by directing the appellant (Acquiring Body) to pay certain sum.

Both sides are in agreement that the same course could be adopted in this matter also.

Having regard to that, the learned Counsel for the applicant makes a statement that the amount which was granted by the Acquisition Authority has already been deposited. Taking into account the contention raised and the observations made in connected petitions, we direct the appellant (acquiring body) to deposit 50% of the enhanced amount within six weeks from today and on said condition, the execution of the impugned award is stayed till further orders.
