It is stated that during the pendency of the present appeal, the aforesaid respondent passed away on 28.07.2022 and her legal heirs i.e.

appellants are already on record. Thus, the counsel wants to delete the name of respondent no.3 from the array of the respondents. The application is supported by affidavit. Death Certificate is on record. Since the application is formal in nature and supported by affidavit, the same is allowed. The applicant is permitted to delete the name of respondent no.3 from the array of respondents, at the risk of the appellants. Necessary amendment be carried out.
