This is an application for condonation of delay of 39 days caused for filing appeal.

Learned Advocate for the applicant pointed out the grounds stated in the application for condonation of delay.

Learned advocate for the applicant pointed out that for getting legal opinion and processing the matter for permission to file appeal, delay of 39 days is caused. Delay is not deliberately caused. Therefore, application deserves to be allowed.

This is an application for granting stay to the execution of the Judgment and award passed by the Commissioner under the Employees Compensation Act and Judge, 2nd Labour Court, Nagpur in Application WCA No.(B)-69 of 2021 dated 18/05/2024.

Learned advocate for the applicant submits that entire amount of Rs.8,87,392/- as per the award is deposited in this Court. The photocopy of said receipt is taken on record and marked as "X-I".

Considering the facts of depositing the entire amount in this Court, the application deserves to be allowed, as prayed and stay is granted as per the Prayer Clause (i).
