The Applicants/Claimants are seeking condonation of delay of 253 days in challenging the Judgment and Award dated 18/9/2023 in MACP No.131/2022, by way of the First Appeal. 3.

The learned Counsel for Respondent No.2/Insurance Company strongly opposed the Application on the ground of delay, being inordinate and unexplained.

However, considering the statutory right of the Applicants and the reasons mentioned in the Application, Civil Application stands allowed in terms of its prayer, subject to costs of Rs.500/- to be paid to the Vidarbha Lady Lawyers Association, Nagpur within a period of two weeks from today.

It is made clear that the Applicants shall not claim any interest for the aforesaid period of delay on the enhanced amount of compensation, if granted.
