The respondent no.1/Claimant is seeking withdrawal of entire amount of compensation alongwith interest. However, in other similar matter, this Court, vide order dated 17-01-2025 and 22-01-2025 in First Appeal No.1041/2023 has already permitted the applicants therein to withdraw 75% of the deposited amount of compensation.

As such the respondent no.1/claimant is also permitted to withdraw 75% of the deposited amount of the compensation I.e 50% on furnishing usual undertaking and 25% on solvent surety along with the proportionate interest accrued thereon till date to the sanctification of the Registrar (Judicial) of this Court.

The remaining amount be invested in FDR in any Nationalized bank on yearly renewal basis during the pendency of the Appeal. 5.

Application is disposed of accordingly.
