ORDER

(Passed on 10.05.2025) 1.

By this application, the applicant/original appellant is seeking correction of mathematical error in terms of compromise signed between the parties before the National Lok Adalat.

In view of the reasons mentioned in the application, the amount which is mentioned in the earlier settlement of Rs.18,902.50/- is to be corrected as Rs.12,500/-. The claimant would be entitled 50 % of the statutory deposit i.e. Rs.12,500/- which is mistakenly written as Rs.6,097.50/-. In view of the said correction, the award is to be modified. The parties are entitled to receive the settlement copy of the modify award along with the form 'N'. 3.

During the pendency of the appeal, appellant National Insurance Company has deposited the total amount of Rs.27,805/-. Subsequently, the ICIC Lombard General Insurance has also deposited 50% of the amount of 25,000/- that comes to Rs.13,903/-.

In view of that the National Insurance Company is entitled to get refund 50% of the amount of Rs.27,805/-.
