This is an application filed by respondent no.1/Original Claimant seeking permission to withdraw the amount of Rs.1,76,235/- deposited by the appellant with this Court towards the compensation of land acquired.

Having heard the respective submissions and on perusal of the record, I am of the opinion that the respondent no.1/Original Claimant be permitted to withdraw the amount of Rs.76,235/- on furnishing usual undertaking and balance amount of Rs.1,00,000/- should remain deposited till final disposal of the appeal. 4.

The application is partly allowed. The respondent no.1 is permitted to withdraw the amount of Rs.76,235/- along with the accrued interest till the date of disbursement.
