This is an application for condonation of delay of 142 days in filing the statutory appeal.

In response to the notice on this application, Advocate Mr. A.P. Deshmukh, appears and waives for respondent No.1.

Learned counsel for the applicant submits that the delay occurred on account of seeking necessary permissions and approvals in filing the statutory appeal. 4.
Having regard to the contents of the application and submissions advanced, the delay of 142 days does not appear to be intentional and the application needs to be allowed in the interest of justice. Accordingly, the civil application is allowed. Delay of 142 days in filing the statutory appeal is hereby condoned.

In view above, the civil application is disposed of.

By this application, the applicant seeks permission to withdraw the amount of compensation deposited by the appellant-Acquiring Body.

The original claimant is seeking withdrawal of amount, which amount is towards the amount of enhanced compensation.

Having regard to the contents of the application and submissions advanced, the respondent No.1/original claimant is entitled to withdraw 50% of the deposited amount with accrued interest, subject to furnishing usual undertaking before the Registrar (Judicial).

In view of above, civil application is allowed and disposed of.
