No. 43/2023 Coram : Registrar(Judicial) Dated : 04.04.2024 This application is taken out for grant of permission to delete the name of respondent nos. 3 to 6 from the array of the respondents. It is stated in the application that the respondent no.1 and 2 have filed Special Civil Suit No. 567/2015 for declaration, possession, permanent injunction and cancellation of sale deed against the present appellant and other respondents in this appeal. It is further stated that since the plaintiffs/respondent no.1 and 2 were trying to create third party interest in the suit property, the appellant filed application for grant of temporary injunction for restraining the plaintiffs to alienate the suit property. The said application Exh. 48 is under challagne in this appeal on its rejection. The appellant states that no relief has been claimed by the appellant against rest of the respondents. Thus, the appellant prays for deletion of names of respondent nos. 3 to 6 from the array of the respondents in the present appeal. The application is supported by affidavit.

Since the application is formal in nature and supported by affidavit, the same is allowed. The appellant is permitted to delete the name of respondent nos. 3 to 6 from the array of respondents, at the risk of the appellant.
