JANUARY 13, 2026 1) This is an application seeking condonation of delay of 103 days caused in filing Second Appeal. It is stated that after the impugned judgment was delivered, the appellants have contacted with Advocate for filing Second Appeal, however, the appeal was not drafted in time, as a consequence of which they were engaged another Advocate as a consequence of which the aforesaid delay has occurred.

2) The respondent though served has not filed reply opposing the application. In view of the aforesaid, application is allowed subject to payment of costs of Rs.2500/- to be deposited in Public Welfare Account, which is ordered to be opened vide order dated 12/01/2026 passed in SMPIL No.01/2021.
