Shrikrishna S/O Ajabrao Sultane v. Ramkrishna S/O Manikrao Pande And Others

CAS No. 333/2024 in Second Appeal No. 260/2015 Coram : Registrar(Judicial) Dated :25.04.2024 This application is filed for bringing legal heirs of respondent no. 8-B- Bhimrao Ajabrao Sultane. It is stated in the application that during the pendency of the present appeal, the respondent no. 8-B passed away on 07.02.2024 leaving behind his legal heirs. It is further submitted in the application that legal heir of the aforesaid respondent i.e. his son namely Jeevan Bhimrao Sultane had passed away prior to the death of respondent no.8-B; thus his legal heirs also needs to be brought on record. Hence it is necessary to bring LRs of the deceased respondent no. 8-B on record as right to sue survives. Copies of death certificates are filed with the application. The application is supported by affidavit.

It is seen that the respondent no. 8-B passed away on 07.02.2024 and the present application for bringing LR's of the deceased is filed on 08.04.2024 i.e. within time and right to sue survives. Hence, the application is allowed. LR's of aforesaid deceased as mentioned in the application be brought on record. Necessary amendments be carried out in the cause title of the appeal memo.
