CAS NO. 443/2024 in Second Appeal No. 193/2006 Coram : Registrar (Judicial) Dated : 20.06.2024 This application is filed by the applicant for bringing legal heirs of deceased appellant no. 1 (iii) Saroj Maniklal Rajore on record. It is stated that during the pendency of the present matter, the said appellant expired on 06.04.2024 leaving behind her legal heirs as mentioned in the application. The application is supported by affidavit.

It is seen that the appellant expired on 06.04.2024 during the pendency of the matter and the present application is filed on 29.04.2024 i.e.

within time stipulated and right to sue survives. Hence, the application is allowed.

Permission is granted to the applicant to bring the legal heirs of the aforesaid deceased appellant on record. Necessary amendments be carried out in the cause title of the appeal.

Second Appeal No. 193/2006 Seen Pursis St. No. 04/2024 dated 04.04.2024. Counsel for appellant to take steps against respondent no.5 who is reported to be dead on 05.07.2017. S.O.
