The applicants claim to be the legal heirs of deceased appellant no. 1. For the reason mentioned in the application, the delay in filing the application for bringing legal heirs on record is condoned since, right to sue survives in favour of the applicants. Permission is also granted to bring their name on record as legal heirs of appellant no. 1.
