Narayan S/O Tukaram Bhakde v. Madhukar S/O Trimbak Kathane (Dead) Thr. Lrs. Anju Manoj Kathane And Others

No. 277/2009 Coram : Registrar(Judicial) Dated : 04.07.2024 This application is filed by the applicant for bringing legal heirs of deceased respondent no.1- Madhukar Trimbak Kathane, on record. It is stated in the application that during the pendency of the present appeal, the aforesaid respondent passed away on 21.03.2024 leaving behind his heirs. The counsel for respondent no.1 vide Pursis St. No. 4/2024 dated 12.06.2024 has informed about the death of respondent no.1. The copy of death certificate is filed on record. The application is supported by affidavit.

It is seen that the aforesaid respondent passed away on 21.03.2024 during the pendency of the appeal and the present application is filed on 19.06.2024 i.e. within time stipulated and right to sue survives. Hence, the application is allowed. Permission is granted to the applicant to bring the legal heris of the aforesaid deceased respondent on record as mentioned in the application. Necessary amendments be carried out in the cause title of the appeal memo.
