CAS No. 957/2024 in Second Appeal No. 200/2010 Coram : Registrar(Judicial) Dated :24.10.2024 This application is filed for seeking permission to delete the name of respondent no.2A from the array of the respondents. It is stated that the legal heirs of respondent no. 2 came to be brought on record i.e. respondent nos. 2A to 2C. It is stated that as per the bailiff report, the said respondent has performed second marriage and she is residing her husband and therefore, the notice returned back unserved for want of correct address.

It is further stated that since she is not a necessary party as to the rights of the respondent no.2 involved in the matter, the applicant wants to delete the name of respondent no.2A from the arrayed of the respondents. The application is supported by affidavit.

Since the application is formal in nature and supported by affidavit, the same is allowed. The applicant is permitted to delete the name of respondent no.2A from the array of the respondents, at the risk of the appellants. Necessary amendment be carried out.
