It is stated that the notice issued to the respondent nos. 6 and 8 are received back unserved for want of insufficient address and the applicant is not aware about the detailed address and thus the applicant wants to delete the said respondents and if they are deleted, no harm would be caused to them. The applicant also wants to delete the name of respondent no. 3 as she is reported to be dead and no harm would be caused if her legal heirs are not brought on record. Thus, the applicant wants to delete the names of respondent nos. 3, 6 and 8 from the array of the respondents. The application is supported by affidavit.

Since the application is formal in nature and supported by affidavit, the same is allowed. The applicant is permitted to delete the names of respondent no.3, 6 and 8 from the array of the respondents, at the risk of the appellants. Necessary amendment be carried out.
