It is stated in the application that during the pendency of the appeal, the aforesaid respondent has expired leaving behind her heirs. It is stated in the application that legal heris of aforesaid respondent are already on record. Therefore, applicant pray for deletion of the name of the R.No.1-a from record.

Since, the application is formal in nature and supported by affidavit, the same is allowed.

The applicant is permitted to delete the name of aforesaid respondent at his own risk.

Counsel to file death certificate of R No. 1-a within a period of three weeks.
