CAS No. 37/2024 in CRA No. 87/2022 Coram : Registrar(Judicial) Dated :05.03.2024 This application is taken out for permission to delete the names of respondent nos.4 and 5. It is stated in the application that respondent nos. 4 and 5 are reported to be dead on 13.03.2021 and 22.03.2022, respectively, as per the bailiff report dated 18.04.2023. It is further stated that respondent nos. 1 to 3 who are daughters of respondent no. 4 are already on record and respondent no.

5 is not having any legal heirs and thus there is no need to bring legal heirs of the aforesaid deceased respondents on record. Thus, the applicant prays for deletion of name of respondent nos.4 and 5 from the array of the respondents. The application is supported by affidavit.

Since the application is formal in nature and supported by affidavit, the same is allowed. The applicants are permitted to delete the name of deceased respondent nos.4 and 5 from the array of the respondents, at the risk of the applicants.

Necessary amendment be carried out.
