Mahendrakumar S/O Kunjilal Agrawal v. Vijayanand S/O Moreshwar Topre

CAS No. 83/2024 in Civil Revision Application No. 50/2021 Coram : Registrar(Judicial) Dated : 03.12.2024 This application is filed by the applicant for bringing legal heir of deceased applicant - Mahendrakumar Kunjilal Agrawal on record. It is stated in the application that during the pendency of the present CRA, the aforesaid applicant passed away on 17.09.2024 leaving behind his heir i.e. wife Smt. Jyoti Mahendrakumar Agrawal as his son predeceased passed away on 10.06.2023. The copy of death certificate is filed on record. The application is supported by affidavit.

It is seen that the aforesaid applicant passed away on 17.09.2024 during the pendency of the CRA and the present application is filed on 19.11.2024 i.e. within time stipulated and right to sue survives. Hence, the application is allowed.

Permission is granted to the applicant to bring the legal heir of the aforesaid deceased applicant on record as mentioned in the application. Necessary amendments be carried out in the cause title of the CRA.
