CAC No. 91/2024 in Civil Revision Application No. 41/2022 Coram : Registrar(Judicial) Dated :07.01.2025 This application is filed for seeking permission to delete the name of respondent no. 2/original defendant no.1 - Smt. Devendrakumar Jagannath Chhabda, from the array of the respondents. It is stated that since beginning of the trial, the respondent no.2 neither appeared nor made any attempt to secure her presence before the learned trial Court as well as before this Hon'ble Court. It is further stated that the applicant had tried his level best to serve the notice against the respondent no.2 and she used to reside with her son somewhere in America and moreover, there is no relief claimed by the applicant against the aforesaid respondent no.2. Thus, the applicant wants to delete the name of respondent no.2 from the array of the respondents.

Since, the application is formal in nature and supported by affidavit, the same is allowed. The applicant is permitted to delete the name of respondent no. 2 from the array of the respondents, at the risk of the applicant. Necessary amendment be carried out.
