NO. 15/2025 IN CONTEMPT PETITION 02/2022 CORAM : REGISTRAR (JUDICIAL) DATED : 14/02/2025 This application is filed under Order XXII Rule 3 of C.P.C. by the counsel for petitioner for bringing legal heirs of deceased petitioner on record. It is stated in the application that during the pendency of the present appeal, the petitioner Sureshchandra Mohanlal Gandhi has expired on 15/04/2024 leaving behind his heirs. The death certificate is annexed with civil application. The application is supported by affidavit.

It is seen that the aforesaid petitioner expired on 15/04/2024 during the pendency of the appeal and the present application is filed on 15/07/2024 i.e. within time stipulated and right to sue survives. Hence, the application is allowed. Permission is granted to bring the legal heirs of the aforesaid petitioner on record. Necessary amendments be carried out in the cause title of the petition.
