Heard learned counsel for the applicant/original contemptner. Learned counsel has submitted that by order dated 16.2.2017, all appeals were disposed of. However, no direction for compliance with the award was passed. Therefore, she urged that it cannot be said that the applicant has committed contempt of this Court. It is further submitted that the applicant is ready to comply with the order of this Court within four weeks from today. It is further informed that after receipt of the contempt notice, due to the election duty, the applicant has forgotten to engage the advocate on time to make the submissions before the Court. That being so, the order dated 06.05.2024 came to be passed. Thus, she has urged to release the applicant on bail.

On perusal of the record, it seems that on 08.01.2024, the contempt notice came to be issued against the applicant. Despite service of notice, the
2 26ca45.2024..odt applicant failed to appear before the Court, hence, vide order dated 06.05.2024, the non-bailable warrant was issued.

Pursuant to the non-bailable warrant, the applicant has been arrested today and produced before the court along with a report. It is to be noted that the applicant is working on the post of Acting Regional Officer of MIDC, Amravati Region, Amravati, and undertakes to comply with the said order within a period of four weeks. The learned counsel for the applicant informs that 50% of the compensation amount has already been deposited in this Court and the same withdrawn by the respective parties.

In such an eventuality, it would not be proper to send the applicant behind the bar. But one more opportunity needs to be given to him to comply with the said order. In view of the above, I deem it appropriate to pass the following order:
Order i) The application is allowed and disposed of. ii) The applicant be released on bail on execution of P.R. bond of Rs. 50,000/- (Rs. Fifty Thousand).
