CAM No. 01/2024 in Arbitration Appeal No. 23/2021 Coram : Registrar(Judicial) Dated : 15.02.2024 This application is filed under Order 5 Rule 20 of the Code of Civil Procedure, 1908, for substituted service upon unserved respondents by paper publication. It is stated that the notice issued to the unserved respondents returned back unserved for want of correct address. It is stated that no other address except the present one is available with the applicant. It is stated that the applicant could not get the correct address inspite of best efforts. The applicant thus prays for substituted service upon aforesaid respondents. Considering the reasons mentioned in the application and the bailiff report, the applicant is allowed to serve aforesaid respondents by substituted service on last known address.

Substituted service be effected upon the unserved respondents by publishing notice in widely circulated local daily newspaper i.e. ('Daily Matrubhumi', Akola Edition), in terms of Order V Rule 20 (1-A) of CPC, returnable within four weeks from the date of publication of notice. Arbitration Appeal No. 23/2021 Reference: Pursis St. No 1/2023 dt.14.09.2023, by which, it was informed that R. No.4 is dead. Seen Pursis St. No. 02/2024. Vide said Pursis, it is informed that respondent no.4 Akashay Sanjay Mishtra is not dead. In view of the Pursis, office to verify and proceed further.
