Heard learned Counsel for the Appellant. The learned Counsel for Respondent No.2, despite appearance, remained absent.

The Application is filed for adding the Applicant as Appellant No.2, since he was Applicant No.2 in the Original Claim Petition.

According to the learned Counsel for Applicant, the earlier Advocate did not join the present Applicant and wrongly mentioned that claim was not allowed against him by the learned Tribunal. However, the impugned Judgment indicates that the claim was allowed against both the Original Claimants. 4.

Under such circumstance, after the death of Original Claimant No.1 Sushila Murlidhar Janbandhu, the present

In view of the same, the Civil Application stands allowed in terms of its prayer and disposed of accordingly. 6.

Since the present Application is allowed, Civil Application (CAF) (St) No.3064/2024 stands disposed of, being infructuous.
