CAO No. 205/2024 in MCA (Review) No. 989/2023 in Second Appeal No. 62/2016 Coram : Registrar(Judicial) Dated : 15.02.2024 This application is filed under Order 5 Rule 20 of the Code of Civil Procedure, 1908, for substituted service upon respondent no.4 by paper publication. It is stated that the earlier notice issued on CAO No. 308/2023 i.e. condonation of delay application in review, came to be returned back unserved due to incomplete address, however, the paper publication was done. It is stated that the applicants are unable to get complete address of the aforesaid respondent. The applicant this time also prays for substituted service upon aforesaid respondent for adjudication of the review application.

Considering the reasons mentioned in the application and the bailiff report, the applicant is allowed to serve aforesaid respondent by substituted service on last known address.

Substituted service be effected upon the aforesaid respondent no.4 by publishing notice in widely circulated local daily newspaper i.e. (Gujarat Today, Ahmedabad (Gujarat) Edition), in terms of Order V Rule 20 (1-A) of CPC, returnable within four weeks from the date of publication of notice.
