Second appeal came to be dismissed for want of prosecution on 15.02.2024. This is an application seeking condonation of delay in filing application for restoration of the said appeal. It is admitted that the appeal came to be dismissed for reasons not attributed by the applicants personally.

In view of the aforesaid, delay of 129 days caused in filing of restoration application is condoned. For the same reasons, Misc. Civil Application St. No.14202 of 2024 for restoration of appeal is condoned. Second Appeal is restored. However, having regard to the delay caused, costs of Rs. 5,000/- are imposed. Costs be paid to the Advocate's Bar Association at Ashti on or before 31.01.2026.
